Request to authorize the City Manager, or his designee, to execute Amendment No. 2 to Contract 142402 with Felix Construction Company (Coolidge, Ariz.) to provide additional Construction Manager at Risk (CMAR) Construction Services in support of the Steel Tank Rehabilitation Program Group I (FY17-18) project. Further request authorization for the City Controller to disburse all funds related to this item.

Summary
There are 40 steel tanks located at 35 different sites serving as potable water storage/pressure surge protection facilities within the City's water production and distribution system. This program was established to extend the service life of these assets, minimize water loss, and protect water quality and public health using a proactive approach. The program includes maintaining the coating and structural integrity of these steel tanks, enhancing water quality (recirculation systems, mixing, disinfection system upgrades, etc.) associated with the steel tank sites, and providing site related improvements, including but not limited to erosion repair and upgrading fencing.
Group I includes coating and structural rehabilitation of three water storage tanks and associated electrical, cathodic protection, and site improvement work. The three tanks are: 2S-ES1, 3A-ES2, and 7A-GS1.
Felix Construction Company will assume the risk of delivering the project through a GMP. Felix Construction Company will be responsible for means and methods related to the project, participating with the City in the goal setting process for Small Business Enterprise (SBE) participation, and implementing the SBE process. Felix Construction Company will also be required to solicit bids from prequalified subcontractors to perform work under the City's subcontractor selection process. Felix Construction Company may also compete to self-perform limited amounts of work.
Procurement Information
Felix Construction Company was chosen for this project using a qualifications-based selection process according to Section 34-603 of the Arizona Revised Statutes. Scoring and selection were made in conjunction with the CMAR Design Phase Services procurement process.
Contract Term
Construction services are expected to be completed within 12 months of issuing the Notice to Proceed.
Financial Impact
Felix Construction Company's fee under this contract will be increased by $2,900,000, for a not-to-exceed amount of $5,228,786.24, including all subcontractors and reimbursable costs. Funding for these services is available in the Water Services Department's Capital Improvement Program budget. Contract payments may be made up to the contract limits for all rendered contract services, which may extend past the contract termination.
Previous Council Action
City Council approved Contract 142402 on April 6, 2016, and approved Amendment No. 1 on June 22, 2016.
