Request to authorize the City Manager, or his designee, to enter into an access and operations agreement with the Arizona Department of Water Resources (ADWR), for groundwater monitoring at various well-site locations for one 25-year term.

Summary
ADWR is tasked with providing stewardship of the State of Arizona's groundwater resources through active management and enforcement of the Arizona Groundwater Code. ADWR has much-needed information regarding the State's water supplies; however, there are a number of areas in which information is limited. To address this issue, ADWR received funding to establish automated groundwater monitoring sites in areas of the State where data is lacking and to improve ADWR's understanding of the water supplies in those areas.
The agreement is for access, construction, installation, maintenance and continuous monitoring of groundwater monitoring well sites. ADWR shall provide insurance and indemnification acceptable to the City's Risk Management Division and the Law Department. The agreement may contain other terms and conditions deemed necessary by the City. ADWR is responsible for all costs related to the monitors, including utility service for the well sites located at:

- 12402 N. 35th Ave., APN 149-29-001E;
- 14429 N. 47th Ave., APN 207-32-030A;

- 2313 W. Cheryl Drive, APN 149-10-001E;
- 3847 W. Earll Drive, APNs 107-17-171 and 107-17-172; and
- 2501 W. Cactus Drive, APN: 149-57-018.
Contract Term
The term of the agreement will be 25 years. The agreement may be terminated by either party upon 30-day written notice, or pursuant to Arizona Revised Statute 38-511.
