Request to authorize the City Manager, or his designee, to accept AJP Electric, Inc. (Phoenix) as the lowest-priced, responsive, and responsible bidder and to enter into an agreement with AJP Electric, Inc. for construction services for the McDowell Road to Palm Lane: 37th to 35th Avenue Sidewalk Improvement project. Further request authorization for the City Controller to disburse all funds related to this item.

Summary
AJP Electric, Inc.'s services will include, but are not limited to: construction of new or removal of sidewalks, curb and gutter, asphalt concrete pavement; provide and install new LED streetlights; water service replacement; trenching and installation of underground conduit; construct a new high intensity activated crosswalk pedestrian signal on 35th Avenue; and other miscellaneous removal and installation of various other work items.
Procurement Information
Four bids were received according to section 34-201 of the Arizona Revised Statutes by the Street Transportation Department on May 16, 2017. The four bids were sent to the Equal Opportunity Department (EOD) for review to determine subcontractor eligibility and general contractor responsiveness in demonstrating compliance with the project’s Disadvantaged Business Enterprise (DBE) goal. EOD deemed the first bidder, AJP Electric, Inc., and the third bidder, Combs Construction Company, Inc., responsive. The two other bidders were deemed non-responsive for not submitting the required documentation. Bids ranged from a low of $539,466.55 to a high of $713,212.00. The Engineer's estimate and the two lowest-priced responsive and responsible bidders are listed below:

Contract Term
The term of the contract is 90 calendar days from the date of issuance of the Notice to Proceed. Contract work scope identified and incorporated into the contract prior to the end of the contract may be agreed to by the parties, and work may extend past the termination of the contract. No additional contract work scope changes may be executed after the end of the contract term.
Financial Impact
This project will utilize federal funds and is subject to the requirements of 49 Code of Federal Regulations (CFR) Part 26 and the U.S. Department of Transportation DBE program. The bid award amount is within the total budget for this project. Funding is available in the Street Transportation Department's Capital Improvement Program budget. Contract payments may be made up to contract limits for all rendered contract services, which may extend past the contract termination.
