Description
Request to authorize the City Manager, or his designee, to execute an amendment to Agreement 145069 with Kimley-Horn and Associates, Inc. to provide additional Engineering Services that include design services for the 3rd Street Promenade: Roosevelt Street to Indian School Road Modernization project. Further request to authorize execution of amendments to the agreement as necessary within the Council-approved expenditure authority as provided below, and for the City Controller to disburse all funds related to this item. The additional fee for services included in this amendment will not exceed $252,622.

Summary
The purpose of this project is to repurpose 3rd Street to serve as a pedestrian connector and an alternative vehicular route into downtown Phoenix. This amendment is necessary based on feedback and input gathered by the design team from the public, project stakeholders and other City departments as part of the preliminary design efforts for this project. Several additional project scope needs were identified including:
- Sidewalk construction to maintain a continuous pedestrian path.
- Adjacent driveway modifications to maintain ADA compliance.
- Increased landscape and hardscape improvements.
- Full replacement of seven signalized intersections.
Kimley-Horn and Associates, Inc.’s additional services include, but are not limited to: design of traffic modifications for flashing yellow arrows along 3rd Street; driveway retrofit design and plan preparation for driveways along the project; design and plan preparation for additional sidewalk ramps on intersection corners where traffic signals are being placed; landscape and irrigation gap plan preparation for 60 percent submittal; additional coordination and design time to develop full landscape/irrigation 95 to 100 percent plans; and preparation of legal descriptions and right of way exhibits for properties that will require acquisition due to driveway and sidewalk retrofits.
Contract Term
The term of the agreement will be extended by 720 calendar days from the original contract term. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.
Financial Impact
- The initial agreement for Design Services was executed for a fee not-to-exceed $752,710, including all subconsultant and reimbursable costs.
- This amendment will increase the agreement by an additional $252,622, for a new total not-to-exceed agreement value of $1,005,332.
Funding is available in the Street Transportation CIP budget.
