Authorization to Enter into Intergovernmental Agreement with Arizona Department of Health Services (Ordinance S-45984)

 

Description

Request authorization for the City Manager, or his designee, to allow the Police Department to enter into an Intergovernmental Agreement (IGA) with the Arizona Department of Health Services (ADHS) to enforce regulations regarding unlawful marijuana trafficking taking place outside of registered nonprofit medical marijuana dispensaries. The current contract amount is $150,000; however the Police Department requests to accept additional funds, should they become available, not to exceed $750,000. The funding period is from July 1, 2019 through June 30, 2024. Further request authorization for the City Treasurer to accept, and the City Controller to disburse, all funds related to this item.

Summary

Proposition 203 was certified on Nov. 13, 2010, becoming the Arizona Medical Marijuana Act (AMMA). The AMMA and Medical Marijuana Program rules allow for the registration, certification, and regulation of nonprofit medical marijuana dispensaries. The ADHS may not issue more than one nonprofit Medical Marijuana Dispensary Registration Certificate (DRC) for every 10 registered pharmacies in Arizona.

 

The funding provided by ADHS will reimburse the Police Department for overtime and related fringe benefits for the regulation of activities within the City of Phoenix that fall outside of the AMMA and under A.R.S. Title 13. These activities include, but are not limited to, unlawful marijuana trafficking taking place outside of registered nonprofit medical marijuana dispensaries by persons who are representing themselves to cardholding patients and the public as acting within the scope of the AMMA.

 

Contract Term

The term of the contract is from July 1, 2019 through June 30, 2024.

 

Financial Impact

The cost to the city is in-kind resources only.
