Description
Request to authorize the City Manager, or his designee, to accept Lightday Solar, Inc. as the lowest-priced, responsive, and responsible bidder and to enter into an agreement with Lightday Solar, Inc. for Design-Bid-Build Services for the Phoenix Sky Harbor International Airport Electric Ground Support Equipment Infrastructure Terminal 3 and Terminal 4 project. Further request to authorize the City Controller to disburse all funds related to this item. The fee for services will not exceed $628,722.42.

Summary
The purpose of this project is to provide construction services to supply and install 12 airline common-use, dual-port electric ground support equipment (eGSE) chargers on the ramp levels of Terminal 3 N, Terminal 4 S2, and Terminal 4 S3 concourses. This project will support and promote the use of eGSE chargers, including for airline-owned aircraft pushback and baggage cart tugs, which will reduce airport emissions.
Lightday Solar, Inc.’s services include, but are not limited to: installing new electrical wiring, conduits, chargers, protective bollards, and other work required to complete the project. Staff anticipates reimbursement from the Federal Aviation Administration (FAA) Voluntary Airport Low Emissions (VALE) grant.
Procurement Information
The selection was made using an Invitation for Bids procurement process set forth in section 34-201 of the Arizona Revised Statutes. Three bids were received on July 2, 2019 and were sent to the Equal Opportunity Department for review to determine subcontractor eligibility and contractor responsiveness to Disadvantaged Business Enterprise program requirements.

The bid award amount is within the total project budget.
The reason for the variance between the Engineer's Estimate and the lowest bid is the bidder's opinion of timing and market conditions, which the Engineer estimated on the high side for the project. The low bid was approximately 18 percent lower than the Engineer's Estimate. The second lowest bid exceeded the Engineer's Estimate. These diverse bids are not uncommon on low-bid projects.
Contract Term
The term of the agreement is 200 calendar days from issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.
Financial Impact
The agreement value for Lightday Solar, Inc. will not exceed $628,722.42, including all subcontractor and reimbursable costs.
Funding is available in the Aviation Department's Capital Improvement Program budget. Staff anticipates reimbursement from the FAA VALE grant. The Budget and Research Department will separately review and approve funding availability prior to execution of any amendments. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.
