Description
Request to authorize the City Manager, or designee, to acquire an underground reclaimed water pipeline easement along the west side of North 40th Street and north of East Sleepy Ranch Road. Acquisition is for a purchase price and upon such other terms as are established at the Arizona State Land Department (ASLD) public auction. Further request authorization for the City Controller to disburse all funds related to this item.
Further request the City Council to grant an exception pursuant to Phoenix City Code 42-20 to authorize inclusion in the documents pertaining to this transaction of indemnification and assumption of liability provisions that otherwise would be prohibited by Phoenix City Code 42-18, as the ASLD's Certificate of Purchase and other form documents include such provisions.

Summary
Acquisition of an easement is required for construction of a 30-foot wide underground easement for a reclaimed water pipeline for the Cave Creek Landfill Ground Water Treatment System. This is a joint project between the City of Phoenix and Maricopa County to remediate contaminated groundwater from the closed Cave Creek landfill site in north Phoenix.
The property impacted by this project is an unassessed parcel owned by ASLD located along the west side of north 40th Street and north of East Sleepy Ranch Road.
