Description
Request to authorize the City Manager, or designee, to provide access by right-of-way dedication or an access easement over City-owned property and alley improved with a roadway to two vacant development sites at 32nd Street and Cheryl Drive. The dedication or access easement will be completed via a separate instrument and recorded with Maricopa County. Further request authorization for the City Treasurer to accept all funds related to this item.

Summary
The City-owned property, currently improved with a roadway, provides restricted access to the 32nd Street and Shea Park and Ride. The Arizona Department of Transportation (ADOT) owns a vacant development parcel located adjacent to the improved park and ride which currently has no legal access. The vacant development site at the southeast corner of north 32nd Street and east Cheryl Drive has legal access from north 32nd Street, and has frontage along the restricted access roadway with no legal access. Legal access will be provided either by dedication of right-of-way to public use or grant of an access easement over the City-owned property, pending Federal Transit Authority (FTA) approval. In the event that the FTA makes a determination to approve access by easement, compensation will be based on market value.
