Description
Request to authorize the City Manager, or his designee, to apply for an Encroachment Permit through the Arizona Department of Transportation (ADOT) for the 2026 Arizona State Fair.
Further request City Council grant an exception pursuant to Phoenix City Code 42-20 to authorize the inclusion of indemnification and assumption of liability provisions in the document pertaining to this transaction that otherwise would be prohibited by Phoenix City Code 42-18.

Summary
Since 1987, the Phoenix Police and Neighborhood Services departments have partnered with the Arizona Coliseum and Exposition Center to provide traffic and vending enforcement for the annual State Fair. Police Services for the 2026 State Fair will consist of four Police Assistants to assist with vehicle tows, traffic accidents and other non-enforcement issues surrounding the State Fair.
The ADOT requires an Encroachment Permit that will allow the Phoenix Police Department to use land owned by ADOT as a temporary storage lot to house illegally parked or disabled vehicles in connection with the Arizona State Fair and the surrounding area during the State Fair operating hours. The temporary site will not be used for any purpose other than Police ordered vehicle tows related to the Arizona State Fair.
Contract Term
The Encroachment Permit will be valid September 24, 2026 through November 2, 2026.
Financial Impact
There is no financial impact related to the Encroachment Application or Permit.
Concurrence/Previous Council Action
City Council approved an agreement with the Arizona Coliseum and Exposition Center for Police and Neighborhood Services departments to provide traffic and vending enforcement for the 2026 Arizona State Fair (Ordinance S-53091) on August 26, 2026.
