Amend Telecommunications Services and Interstate Telecommunications Services License with Sprint Communications Company, L.P. (Ordinance S-46032)

 

Description

Request to authorize the City Manager, or his designee, to amend and extend a nonexclusive, revocable license with Sprint Communications Company, L.P. to construct, install, operate, maintain and use the Public Highways in the City in order to provide telecommunications services and interstate telecommunications services in, under, over, and across public rights-of-way in the City of Phoenix subject to the terms and conditions contained in the license and Phoenix City Code. There is no cost to the City for this license. Request authority for City Treasurer to accept funds.

Summary

The license will be for a period of five years, contain appropriate insurance and indemnification provisions, require a performance bond and a security fund, provide for terms of transfer and revocation, and provide for the compensation for the commercial use of public rights-of-way while permitting the City to manage the right-of-way.

 

Contract Term

The request is for a five-year renewal of an existing five-year Telecommunication Services and Interstate Telecommunication Services License that was last granted on Nov. 1, 2014 (City Contract 141645-0).

 

Financial Impact

There is no cost to the City. Licensee will pay an annual fee based on a formula using the linear footage and the Consumer Price Index.
