Acquisition of Easements for Water and Wastewater Infrastructure Improvement Project Located West of Interstate 17 between Pioneer Road and Opportunity Way (Ordinance S-43408)

 

Description

Request to authorize the City Manager, or designee, to acquire easements in all or portions of vacant land voluntarily from the Arizona State Land Department for the West Anthem Water and Wastewater Infrastructure Improvement project.  Further request authorization to enter into short-term protective leases to minimize relocation costs and temporary occupancy agreements to allow occupants time to relocate, as may be necessary to and in furtherance of this acquisition. Further request authorization for the City Treasurer to accept, and for the City Controller to disburse, all funds related to this item.

Summary

The easements are needed to allow the City of Phoenix to construct water and wastewater infrastructure and to be able to provide direct water and sewer services to West Anthem, a developed area within the City of Phoenix municipal limits. The improvements will allow for future development within the City of Phoenix area to the north and also provide the backbone utilities for future growth within the intended service area.

 

Further request the City Council to grant an exception pursuant to Phoenix City Code § 42-20 to authorize inclusion in the documents pertaining to this transaction of indemnification and assumption of liability provisions that otherwise would be prohibited by Phoenix City Code § 42-18, as the Arizona State Land Department’s Certificate of Purchase and other form documents include such provisions.

 

Financial Impact

Acquisition is to be for a purchase price and upon such other terms as are established at the Arizona State Land Department's public auction, with the City's maximum bid to be determined by the City Manager in his discretion, consistent with instructions provided by the City Council in Executive Session.
