Description
Request to authorize the City Manager, or the City Manager's designee, to amend Contract 164978 with Maximo Branding LLC dba Joe Ray for the design, fabrication and installation of artwork for the Sueño Park Public Art Project to provide additional funding for implementation of shade elements. Further request to authorize the City Controller to disburse all funds related to this item. This amendment will increase funding by up to $120,000 for a new total contract value not to exceed $250,000.

Summary
The Fiscal Year (FY) 2026-31 Public Art Plan includes funding for artwork located at Sueño Park. In partnership with the Parks and Recreation Department, the Office of Arts and Culture commissioned an artist to enhance the visitor experience at Sueño Park in District 4. The original Contract 164978 for the Sueño Park Public Art Project was approved in the amount of $130,000 by the Phoenix Arts and Culture Commission on January 20, 2026, and approved by the City Council on February 18, 2026 (Ordinance S-52620).
The Office of Arts and Culture staff have received community feedback that the public artwork should have an integrated shade component. An additional $120,000 is needed to cover all costs associated with the implementation of aesthetic and functional shade elements. This will be the first amendment to that contract, increasing the total cost of the contract, as amended, to an amount not to exceed $250,000.
Contract Term
The term of the contract will remain unchanged, ending no later than January 1, 2028, except as extended by mutual written agreement.
Financial Impact
This Project is one of 62 projects in the FY 2026-31 Public Art Plan that the City Council approved on July 1, 2026. The proposed $120,000 funding increase of this amendment in addition to the previously approved $130,000 for the contract will cover all costs associated with the artwork's design, engineering, fabrication and installation. Funding is available in the Office of Arts and Culture Capital Improvement Program budget.
Concurrence/Previous Council Action
The Phoenix Arts and Culture Commission reviewed and recommended this item for approval on August 18, 2026, by a 7-0-2 vote.
The City Council authorized the original artwork design, fabrication and installation Contract 164978 on February 18, 2026 (Ordinance S-52620).
