Description
Request authorization for the City Manager, or his designee, to enter into an Intergovernmental Agreement with the Maricopa County Department of Transportation (MCDOT) to design, construct and maintain a new traffic signal at the intersection of 91st Avenue and Broadway Road. Further request the City Council to grant an exception pursuant to Phoenix City Code Section 42-20 to authorize indemnification and assumption-of-liability provisions that otherwise would be prohibited by Phoenix City Code Section 42-18.

Summary
The City of Phoenix Street Transportation Department seeks to collaborate with MCDOT on the design and installation of a new traffic signal at the intersection of 91st Avenue and Broadway Road. The intersection sits on a jurisdictional boundary, with the south and east approaches located in Maricopa County and the north and west approaches located in the City of Phoenix. A new multifamily development will be constructed at the northeast corner of 91st Avenue and Broadway Road and requires the installation of a traffic signal at the intersection. The traffic signal will be fully funded by the developer.
The City of Phoenix will be responsible for the project's design, construction and maintenance. Maricopa County will issue no-cost permits for project-related work performed within the jurisdiction of the County, including design, construction and traffic control.
Contract Term
The agreement will be effective on the date it is executed by all the Parties and shall remain in effect for 10 years or until all stipulations have been satisfied.
