Description

Request to authorize the City Manager, or his designee, to execute an amendment to Agreement 147356 with Wilson Engineers, LLC, to provide additional Engineering Support Services for the 23rd Avenue Wastewater Treatment Plant (WWTP) Job Order Contract (JOC) Program. Further request to authorize execution of amendments to the agreement as necessary within the Council-approved expenditure authority as provided below, and for the City Controller to disburse all funds related to this item. The additional fee for services included in this amendment will not exceed $1,675,000.

Summary

The purpose of this project is to develop contract documents including construction plans, perform independent cost estimates of JOC projects, perform resident engineering/inspection activities, and represent the City's interest in construction related matters.

 

This amendment is necessary because of the complexity and effort involved with the design of projects, such as boilers, that are critical to the successful operation of the facility. Some of the digester boilers also experienced unanticipated equipment failures during the project. The boilers are required in the fall when temperatures are lower, which creates a short design and construction window over the summer. This increased effort and complexity caused the available funding to be used more rapidly than planned. This amendment will provide additional funds to the agreement.

 

Contract Term

The term of the agreement remains unchanged from the original issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.

 

Financial Impact

  • The initial agreement for Engineering Support Services was executed for a fee not-to-exceed $3,435,000, including all subconsultant and reimbursable costs.
  • Amendment 1 will increase the agreement by an additional $1,675,000, for a new total not-to-exceed agreement value of $5,110,000, including all subconsultant and reimbursable costs.

 

Funding for this amendment is available in the Water Services Department's Capital Improvement Program budget. The Budget and Research Department will separately review and approve funding availability prior to the execution of any amendments. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.
