Request to authorize the City Manager, or his designee, to execute Amendment 2 to Intergovernmental Agreement (IGA) 142038 with the Arizona Department of Transportation (ADOT) to increase the City's non-reimbursed share or cash match for the railroad improvements at 35th Avenue north of Harrison Street. Further request to authorize the City Controller to disburse all funds related to this item. The City’s additional non-reimbursed share or cash match will increase by $17,500 for a not-to-exceed amount of $60,000.

Summary
On Nov. 18, 2015, Council approved entering into an IGA for the Union Pacific Railroad Improvement Project and the Street Transportation Department entered into IGA 142038 with ADOT on Feb. 1, 2016, for railroad improvements at 35th Avenue north of Harrison Street. Based on the original Council authorization, the City's non-reimbursed cost share for this project was $15,400. On Aug. 28, 2019, Council approved Amendment 1 to the IGA with ADOT, increasing authorization for the City's non-reimbursed cost share to a not-to-exceed amount of $42,500, and adjusting the IGA to incorporate ADOT's policy change increasing agencies' cost share for railroad improvement projects from 5.7 percent to 10 percent.
Through continued collaboration between the City, ADOT and the Union Pacific Railroad (UPRR), the project design has been incorporating additional civil and safety improvements at the railroad crossing, which has increased project costs due to additional equipment and surface railroad track work that was not previously anticipated. This has increased the City's non-reimbursed share or cash match for the railroad improvements to a new not-to-exceed amount of $60,000. To date, the City has paid $42,500 and the City's remaining balance is $17,500.
ADOT will invoice the City for the $17,500 balance upon execution of Amendment 2.
Financial Impact
• The City’s initial non-reimbursed cost share was $15,400.
• Amendment 1 increased authorization for the City's non-reimbursed cost share to $42,500.
• This amendment will increase authorization for the City’s non-reimbursed cost share by an additional $17,500 to $60,000.
Within the total authorized amount, upon execution of this amendment, ADOT will invoice the City $17,500, which is the difference paid to date for the local cash match. Funding for this project (ST85100339) is available in the Street Transportation Department's Capital Improvement Program budget.
