Reimbursement Agreement for Preliminary Engineering Services (Ordinance S-53173) - Districts 7 & 8
Description
Request to authorize the City Manager, or the City Manager’s designee, to enter into an Agreement with Union Pacific Railroad Company (UPRR), a Delaware corporation, to perform engineering services for the Rio Salado to Jefferson Street connector project. Further request the City Council to grant an exception pursuant to Phoenix City Code Section 42-20 to authorize indemnification and assumption of liability provisions that otherwise would be prohibited by Phoenix City Code section 42-18. Further request the City Controller to disburse all funds related to this item. The total estimated financial impact on the City is not to exceed $66,000.

Summary
The purpose of this project is to connect the future Rio Salado Bicycle/Pedestrian Bridge to Downtown Phoenix via an active transportation network. This project will expand transportation opportunities for disadvantaged neighborhoods by connecting communities to the existing and future light rail stations, trails, schools, and employment opportunities, enhance safety connections, and improve American with Disabilities (ADA) facilities. The Project may affect UPRR's track, right-of-way, or operations within the project area.
UPRR, and/or its representatives, agree to perform preliminary engineering services for the affected area at the City of Phoenix's sole cost and expense. The services include, but not limited to: conducting field diagnostics and inspections, reviewing construction documents, reviewing Quiet Zone documentation and providing comments, project design, preparing project estimates for force account grade crossing inventory updates, and attending meetings and travel.
Financial Impact
The total estimated City contribution is not to exceed $66,000. Funding is available in the Street Transportation Department's Capital Improvement Program budget.
Location
Street right-of-way segments intersecting the Union Pacific railroad tracks within the project limits, generally located about 300 feet south of Jackson Street and 3rd Street.
