Description

Request to authorize the City Manager, or his designee, to execute an amendment to Agreement 144666 with PCL Construction, Inc. to provide additional Construction Manager at Risk (CMAR) Construction Services for the 91st Avenue Wastewater Treatment Plant (WWTP) Sub-Regional Operating Group (SROG) Digester Dome Replacement project. Further request to authorize execution of amendments to the agreement as necessary within the Council-approved expenditure authority as provided below, and for the City Controller to disburse all funds related to this item. The additional fee for services included in this amendment will not exceed $1.4 million.

Summary

The purpose of this project is to replace the fixed dome for Digester 12 at the 91st Avenue WWTP. This dome is the first of four fixed domes that will be replaced as part of this SROG Digester Dome Replacement project. Digester Domes 2, 3, and 4 will be replaced as part of this contract through future amendments. The existing dome is structurally deficient due to age and the corrosive environment within the digesters. The anaerobic digesters are critical to the solids treatment process at the plant. The project will include removal of the existing dome, fabrication and installation of a new dome, rehabilitation and coating of the digester's interior wall, installation of protective coatings to the interior of the digester domes and installation of roofing material and ancillary equipment on the exterior of the digester dome.

 

This amendment is necessary to begin construction phase of the project for Digester Dome 12. This amendment will provide additional funds and time to the agreement. This Amendment is essential to the health, safety, and welfare of the public and critical operations for the City.

 

The 91st Avenue WWTP is owned by the SROG and operated by the City of Phoenix.

 

Contract Term

The term of the agreement amendment is 425 calendar days from issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.

 

Financial Impact

  • The initial agreement for Construction Services was executed for a fee not-to-exceed $13,599.32, including all subconsultant and reimbursable costs;
  • Amendment 1 increased the agreement value by $900,000, including all subconsultant and reimbursable costs;
  • Amendment 2 will increase the agreement by an additional $1.4 million, for a new total not-to-exceed agreement value of $2,314,000, including all subcontractor and reimbursable costs.

 

Funding for this amendment is available in the Water Services Department's Capital Improvement Program budget. The Budget and Research Department will separately review and approve funding availability prior to the execution of any amendments. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.

The SROG Advisory Committee:

  • Approved the project on Feb. 18, 2016.

 

The SROG Managers Committee:

  • Approved the project on March 9, 2016.

 

The City Council approved:

  • Pre-Construction Services Agreement 142546 (Ordinance S-42516) on May 4, 2015; and
  • Construction Services Agreement 144666 (Ordinance S-43343) on March 22, 2017.
