Description
Request to authorize the City Manager, or his designee, to enter into separate agreements with Felix Construction Company (Coolidge, Ariz. - 3006169) and MGC Contractors, Inc. (Phoenix - 3011953) to provide Construction Manager at Risk (CMAR) design phase services for the Aquifer Storage and Recovery (ASR) Wells and Water Production Wells project. Each firm will be assigned five wells to provide CMAR services. Further request authorization for the City Controller to disburse all funds related to this item.

Summary
The City plans to install four production wells and six ASR wells for this project. The production capacity anticipated for the wells will be between 1,000 and 1,800 gallons per minute. Water pumped from the wells will be used to supplement potable water for customers throughout Phoenix. The goal of these wells is to augment Phoenix’s potable water resources during times of long-term water shortages, emergency outages, and to balance potable system demand.
Felix Construction Company and MGC Contractors, Inc., will begin in an agency support role for design phase services and then hold the construction services contract for the project with the City. The firms' services will include: cost estimating, project planning and scheduling to minimize interruption to City operations, alternative systems evaluation, permitting process assistance, long-lead item procurement, and additional services as needed.
Procurement Information
Felix Construction Company and MGC Contractors, Inc., were chosen for this project using a qualifications-based selection process according to Section 34-604 of the Arizona Revised Statutes (A.R.S.). Pursuant to A.R.S. Title 34, the City is not to release the scoring of proposers until a contract has been awarded. There were nine firms who submitted and the top-four rankings follow:

Contract Term
Each CMAR design phase services contract term of service is expected to be two years from issuance of the Notice to Proceed. Contract work scope identified and incorporated into the contract prior to the end of the contract term may be agreed to by the parties and work may extend past the termination of the contract. No additional contract work scope changes may be executed after the end of the contract term.
Financial Impact
Felix Construction Company and MGC Contractors, Inc., fees under the contracts will not exceed $375,000 each for a total of $750,000, including all subconsultant and reimbursable costs. Funding is available in the Water Services Department’s Capital Improvement Program budget. Contract payments may be made up to contract limits for all rendered contract services, which may extend past the contract termination.
