Description
At the request of the Fire Department, the exemption status under the Fair Labor Standards Act (FLSA) of the classification of Fire Prevention Supervisor has been reviewed. In accordance with the recommendation of Human Resources Committee 603, the Human Resources Department is requesting the following action:

Change the exemption status of the classification of Fire Prevention Supervisor, Code 61120, Salary Plan 001, Grade 035 ($4533 - $6770) from Exempt to Non-Exempt.

Summary
The Fire Marshal is the appointed legal authority for the enforcement of the Fire Code. In accordance with the Fire Code, the Fire Marshal has the authority to appoint “Deputy Fire Marshals” delegating the legal authority of the Fire Marshal’s Office to multiple Fire Prevention Supervisors to provide for a continuous response capability. These Fire Prevention Supervisors will act on behalf of the Fire Marshal in deeming structures or operations unsafe, ordering evacuations of buildings, and issuing Civil Citations. Current staffing levels require a significant amount of after hours’ emergency response in a capacity no longer consistent with the exempt status.

Financial Impact
The estimated cost of this action for a full fiscal year, including benefits, is $18,500.
