Title

Update to the Neighborhood Services Department's Code Enforcement Policy - Citywide

Description

This report requests the Community Services and Education Subcommittee recommend City Council approval of the proposed update to the Neighborhood Services Department's (NSD) Code Enforcement Policy (CEP).

THIS ITEM IS FOR CONSENT ACTION.

Report

Summary

The CEP provides guidelines for enforcement of the Neighborhood Preservation Ordinance, Zoning Ordinance and portions of other City codes/ordinances enforced by NSD (Attachment A). Section I of the CEP establishes the standard code enforcement process, and exceptions to the standard code enforcement process. NSD staff is proposing the following additions to the exceptions outlined in Section I.B.6:

•                     Create new section titled, "Existing Structure Setback Violations."

•                     Add language to describe the enforcement process for setback violations that have existed for more than 10 years or are constructed for the purpose of mitigating the impacts of heat.

•                     Add language to clarify when the standard code enforcement process will be followed.

The staff recommended update to the CEP is highlighted on page five of Attachment B, with the current CEP provided as Attachment A for reference.
