Description

Request to amend Phoenix City Code (PCC), Chapter 19 to add a secondhand dealer licensing exemption for manufacturers of personal devices or providers of mobile services that offer in-store credit only for the return of a wireless device.

Summary

Wireless communication and commercial mobile service providers have requested a secondhand dealer licensing exemption from the City based on the premise that the identification and documentation required and maintained for all in-store device transactions meets and/or exceeds the transaction reporting requirements that licensing requires and would be available to law enforcement investigating an alleged theft. The Police Department has reviewed the request and supports an exemption for providers that offer in-store credit only for the exchange of used wireless devices.

 

Licensing exemption language has been drafted by staff, reviewed by the Law Department and is attached to this report.

 

In January 2017, staff notified existing stakeholders of the proposed licensing exemption and draft language and provided an opportunity for input. No stakeholder objections were received.
