Description
Request to authorize the City Manager, or his designee, to enter into an Intergovernmental Agreement (IGA) between the City of Phoenix and the City of Tolleson, Maricopa County, and the Arizona Department of Transportation (ADOT) for the installation, maintenance and operation of fiber and conduit infrastructure being installed as part of the McDowell Road: 83rd Avenue to 91st Avenue and 91st Avenue: McDowell Road to Lower Buckeye Road Project. Further request the City Council to grant an exception pursuant to Phoenix City Code section 42-20 to authorize indemnification and assumption of liability provisions that otherwise would be prohibited by Phoenix City Code section 42-18. The total estimated financial impact to the City is $133,118. Additionally, request the City Controller to disburse all funds related to this item.

Summary
The City of Phoenix intends to install approximately four miles of fiber and conduit infrastructure along McDowell Road from 83rd Avenue to 91st Avenue and along 91st Avenue from McDowell Road to Lower Buckeye Road, located within the City of Phoenix, the City of Tolleson, and Maricopa County. The project will connect to the existing City of Phoenix and City of Tolleson infrastructure with a direct fiber connection to coordinate during non-recurring congestion and provide an agency-to-agency communication path for the City of Tolleson to connect to the Regional Community Network. The project will implement reliable communication paths to connect Maricopa County fiber infrastructure and traffic signals and connect the City of Phoenix and City of Tolleson's traffic signals to extend all three agencies' real-time traffic management capabilities. The project will also provide a dependable connection to ADOT fiber. The IGA sets forth the responsibilities of the participating agencies for the construction and maintenance of the project.
Contract Term
Unless otherwise lawfully terminated by the Parties, this Agreement expires upon completion and acceptance of the project and fulfillment of all terms of the agreement.
Financial Impact
The project is funded from local and federal funds through the Maricopa Association of Governments (MAG) Transportation Improvement Program (TIP). The estimated construction cost is $2,335,395, which is made up of federal funds of $2,202,277 and a local match of $133,118. This agreement is contingent upon the availability of federal funds through the MAG TIP. Funding is available in the Street Transportation Department's Capital Improvement Program.
