Request to authorize the City Manager, or his designee, to amend the Intergovernmental Agreement (IGA) 153415 between the City of Phoenix and the City of Tolleson to divert, treat and transport Tolleson's Salt River Valley Water Users' Association entitlement water allocation, and further providing for emergency backup water service. There is no financial impact associated with this IGA.

Summary
On October 7, 2020, the City Council approved IGA 153415 that allows the City of Phoenix Water Services Department to divert, treat and transport all or part of the City of Tolleson's annual entitlement water, and if needed, provide emergency backup water. The existing IGA identified two interconnect locations as water delivery points between the two cities.
This amendment addresses the addition of a new interconnect by the City of Tolleson, bringing the total number of water delivery interconnects between the two cities to three total. The existing and new locations are at:
- 83rd Avenue and Interstate 10 - Current
- 67th Avenue and Buckeye Road - Current
- 91st Avenue and Buckeye Road - New
The amendment also expands the limitation on the total water amount that Tolleson can receive annually, capping it at an absolute limit of 7,846.68 acre-feet between all three interconnects. Maximum flow rates are also imposed at each interconnection. Additionally, Tolleson is responsible for modifying the current interconnects, and constructing the new interconnect, so that they are all equipped to allow the City of Phoenix to remotely control the operation of the interconnects, including turn-on and turn-off from the City’s SCADA system.
Under the amended agreement, Tolleson is responsible for all costs associated with the design, permit and construction of the new interconnect site. Tolleson is also responsible for the costs to procure a third-party consultant to provide technical assistance to the City of Phoenix throughout the design and construction of the new interconnect. Phoenix will inspect and approve all plans and specifications prior to operation.
Contract Term
The term of the IGA was for a period of 10 years commencing December 1, 2020, with an option for a 10-year extension. This amendment shall become effective upon the full completion of signing and dating by all Parties and does not change the term of the IGA.

There is no financial impact associated with this IGA.
