Description
Request to authorize the City Manager, or his designee, to enter into a land use license with Salt River Project at Val Vista Water Treatment Plant, south bank of the south canal located in the SE quarter of Section 32, Township 02N, Range 06E of the Gila and Salt River Meridian. Further request the City Council to grant an exception pursuant to Phoenix City Code 42-20 to authorize inclusion in the documents pertaining to this transaction of indemnification and assumption of liability provisions that otherwise would be prohibited by Phoenix City Code 42-18.

Summary
The land use license is necessary for the City of Phoenix to maintain the block wall, underground electrical facilities, and operation of the West Plant and East Plant inlet structures, located on the south bank of the South Canal. The license will allow nonpossessory and nonexclusive right and privilege to enter upon and use certain real property for the maintenance of the inlet structures.
Contract Term
The term of the license shall be for ten years beginning on October 1, 2025, and ending September 30, 2035. The license may be renewed upon written agreement by the parties.
Financial Impact
The financial impact is a one-time license fee in the amount of $7,982 paid by the City of Phoenix. Funds for this fee are available in the Water Services Department's operating budget.
