Description
This report requests that the Transportation, Infrastructure and Innovation Subcommittee recommend the City Council authorize the City to enter a Jet Fuel Remediation and Technical Dispute Environmental Consulting Service contract with Weston Solutions, Inc. for three years, with two, one-year renewal options. The total estimated cost is $250,000 over five years. The contract term is an initial 3-year period and will commence on July 1, 2020.

Summary
The Arizona Fueling Facilities Corporation (AFFC) 2005 Consent Decree provides for AFFC/City collaborative review of new airport projects impacting the jet fuel remediation area. Previous consulting service contracts have been used to evaluate remediation progress and support airfield construction projects but the last contract expired in April 2020.
AFFC and City executed a Subsequent Agreement in April 2020 that continues AFFC/City collaborative review after termination of the Consent Decree. This consulting service is necessary to support redevelopment projects in the remediated area generally bounded on the east by Terminal 2 and on the west by 24th Street and extending north from Sky Harbor Blvd to Runway 8/26. Specific near-term Airport projects requiring consulting service support include the Terminal 2 Demolition projects, Sky Train Stage 2, and planned redevelopment infrastructure and terminal buildings as proposed in the Comprehensive Asset Management Plan (CAMP).
Costs are reimbursable by AFFC if mitigation in the remediated area is required to meet safety standards for the future infrastructure project.
The Consent Decree and subsequent agreement work may be subject to Dispute Resolution. This consulting service will provide technical support in the event of dispute resolution. The Subsequent Agreement requires reasonable efforts of AFFC/City to resolve disputes through negotiation. If unable to resolve the dispute through negotiation, either party may initiate legal action with the appropriate court in Maricopa County or both parties may mutually agree to binding arbitration to resolve the dispute.
Procurement Information
On February 27, 2020, AVN issued the RFP Package for the Jet Fuel Remediation and Technical Dispute Environmental Consulting Service. AVN received two responses to its RFP on April 13, 2020; all were deemed responsive.
The panel members evaluated and deliberated on the submitted responses based on the following criteria established in the RFP:

The consensus score and ranking for the Respondents are shown below:
- Proposer No. 1: Clear Creek Associates LLC: 711.5 points
- Proposer No. 2: Weston Solutions, Inc.: 920 points
Contract Term
The term will be three years and will begin on or about July 1, 2020. The contract will include two, one-year renewal options to be exercised at the sole discretion of the Director of Aviation Services.
Financial Impact
The total estimated cost is $250,000 over five years. The funding is available in the Planning & Environmental Division operating budget. Costs are reimbursable by AFFC, if mitigation in the remediated area is required to meet safety standards for the future infrastructure project.
