This report provides the Economic Development and Equity Subcommittee with information regarding Z-TA-5-23-Y, a text amendment to the Phoenix Zoning Ordinance to address Accessory Dwelling Units (ADUs).

Summary

In July of 2020, Mayor Kate Gallego announced the City’s first-ever Housing Phoenix plan, which was unanimously approved by City Council in June of 2020 and established a goal of creating or preserving 50,000 homes by 2030 to address the housing shortage in Phoenix. Within this plan, a number of policy initiatives were identified, one of them entitled “Amend Current Zoning Ordinance in Target Areas to Allow for Accessory Dwelling Units” with a proposed adoption time frame within 18 months of the approval of the Housing Phoenix Plan.

 

The intent of the proposed text amendment is to respond to City Council and stakeholder requests to allow an ADU to be constructed on a lot with a detached single-family home only, by providing reasonable increases in permitted lot coverage and by allowing an ADU to be located within the rear yard, with conditions. The proposed amendment revises and/or deletes related definitions with new definitions provided as necessary: “ADU” has been added to the use lists in appropriate zoning districts; development regulations specific to ADUs have been added; existing development regulations have been modified to address ADUs; related terms and references to ADUs have been clarified and updated; and certain sections have been reorganized for ease of use and clarity.

 

The anticipated schedule for this text amendment is as follows:

 

  • June 2023 - Village Planning Committees for Information Only.
  • July 2023 - Village Planning Committees for Recommendation.
  • Aug. 3, 2023 - Planning Commission.
  • Sept. 6, 2023 - City Council.
