Lift Station 66 and Lift Station 77 Wastewater Infrastructure Modifications - Construction Administration and Inspection Services - WS90501009 (Ordinance S-53101) - Districts 1 & 2
Description
Request to authorize the City Manager, or his designee, to enter into separate agreements with two consultants listed below to provide Engineering Services that include construction administration and inspection services for the Lift Station 66 and Lift Station 77 Wastewater Infrastructure Modifications project. Further request to authorize execution of amendments to the agreements as necessary within the Council-approved expenditure authority as provided below, and for the City Controller to disburse all funds related to this item. The total fee for all services will not exceed $15 million.
Additionally, request to authorize the City Manager, or his designee, to take all action as may be necessary or appropriate and to execute all design and construction agreements, licenses, permits, and requests for utility services related to the development, design and construction of the project. Such utility services include, but are not limited to: electrical, water, sewer, natural gas, telecommunication, cable television, railroads and other modes of transportation. Further request the City Council to grant an exception to Phoenix City Code 42-20 to authorize inclusion in the documents pertaining to this transaction of indemnification and assumption of liability provisions that otherwise should be prohibited by Phoenix City Code 42-18. This authorization excludes any transaction involving an interest in real property.

Summary
The purpose of this project is to include developer upgrades to existing Lift Stations 77 and 66 to increase capacity for future flows in the area. The upgrades will also include installation of a new gravity main from the Lift Station 77 discharge structure to Lift Station 66 and a new force main from Lift Station 66 to Cave Creek Road.
The Engineering consultants' services include, but are not limited to oversight services of: installing an additional pump within the existing wet well at Lift Station 77; installing a new wet well at Lift Station 66, along with new pumps, odor control improvements, and necessary electrical upgrades to increase capacity from the new wet well at Lift Station 77; right-of-way work for installing a new gravity main from the Lift Station 77 discharge structure located at 29th Avenue and Sonoran Desert Drive to Lift Station 66; installing a new force main from Lift Station 66 to Cave Creek Road north of Pinnacle Peak Road; and installing a section of gravity main from the discharge to the Cave Creek Water Reclamation Plant. Installation may include gravity and force mains in both right-of-ways and easements.
Procurement Information
The selections were made using a qualifications-based selection process set forth in section 34-604 of the Arizona Revised Statutes (A.R.S.). In accordance with A.R.S. section 34-604(H), the City may not publicly release information on proposals received, including the scoring results, until an agreement is awarded. Six firms submitted proposals and are listed below.

Contract Term
The term of each agreement is five years from the issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.
Financial Impact
The agreement value for each of the Engineering consultants will not exceed $7.5 million, including all subconsultant and reimbursable costs. The total fee for all services will not exceed $15 million, including all subconsultant and reimbursable costs.
Funding is available in the Water Services Department's Capital Improvement Program budget. The Budget and Research Department will separately review and approve funding availability prior to execution of any amendments. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.
