Description

Request to authorize the City Manager, or his designee, to enter into an agreement with BrightView Landscape Services, Inc. (Phoenix) to provide Citywide Street Landscape Maintenance Job Order Contracting (JOC) services and to execute contract options as necessary. Further request authorization for the City Controller to disburse all funds related to this item.

Summary

The JOC contractor will provide the maintenance and restoration of established right-of-way landscaping and irrigation systems to include, but not limited to: backflow prevention systems repair, replacement and testing, herbicide applications to inhibit or eradicate weed growth, planting, pruning and removal of landscape, repair and/or install various types of fencing and traffic control bollards, graffiti removal, and repair or replace concrete pedestrian pathways and miscellaneous concrete flat work within Phoenix city limits.

 

Procurement Information

BrightView Landscape Services, Inc. was chosen for this project using a two-step qualifications- and price-based selection process according to section 34-604 of the Arizona Revised Statutes (ARS). The procurement allowed for the selection and award of up to three firms based on the City’s anticipated workload.

Contract Term

The JOC will be for a three-year term with an option to renew for an additional two-year term or maximum funding capacity, whichever occurs first. Contract work scope identified and incorporated into the contract prior to the end of the contract may be agreed to by the parties, and work may extend past the termination of the contract. No additional contract work scope changes may be executed after the end of the contract term.

 

Financial Impact

The three-year base term of the contract will have a maximum available contract capacity of $3.3 million. The two-year renewal option, if exercised, will provide an additional $2.2 million in capacity, for a total maximum available contract capacity of $5.5 million over the five-year term of the contract, including all amendments. Authorization is requested to execute individual job order agreements performed under this JOC for up to $1.2 million each in contract costs to account for typical and anticipated cost escalations for annual contract services through the five years of the contract. In no event will any job order agreement exceed this limit without Council approval to increase the limit. Contract payments may be made up to contract limits for all rendered contract services, which may extend past the contract termination.

 

The first job order agreement to be issued will not exceed $1,060,000, which will cover landscape maintenance services per the scope of the contract for the first year of the contract.

 

Operating and Capital Improvement Program funding may be utilized. The Budget and Research Department will review and approve funding availability prior to the issuance of any job order agreement.

 

Small Business Outreach

A Small Business Enterprise goal of seven percent has been established for this contract.

 

Previous Council Action

On Feb. 1, 2017, City Council approved Contract 144402 with Basin Tree Service & Pest Control, Inc. DBA United Right-of-Way.
