Description
Request to authorize the City Manager, or his designee, to execute change order to Agreement 145067 with Combs Construction Company, Inc., to provide additional Design-Bid-Build Services for the Grand Canalscape Phase I Uptown and Gateway North project. Further request to authorize execution of amendments to the agreement as necessary within the Council-approved expenditure authority as provided below, and for the City Controller to disburse all funds related to this item. The additional fee for services included in this change order will not exceed $783,913.15.

Summary
The purpose of this project is to construct a 10-foot concrete pathway along the north bank of the Grand Canal between 15th Avenue and 16th Street and along the south bank of the Grand Canal between approximately 36th Street and 40th Street.
This change order is necessary to add scope of work including fabrication and installation of the new Brophy-Central Pedestrian Bridge, retaining walls, hand railings, ADA improvements, trash receptacles, dog waste stations, and additional fencing. This change order will provide additional funds and time to the agreement.
Combs Construction Company, Inc.'s additional services include, but are not limited to: pathway lighting, landscape and irrigation, and artist-designed features such as shade canopies, benches, landscape walls, trail markers, and pavers.
Contract Term
The term of the agreement amendment is 150 calendar days from issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.
Financial Impact
- The initial agreement for Design-Bid-Build Services was executed for a fee not-to-exceed $3,620,983, including all subcontractor and reimbursable costs.
- Change Order 1 increased the agreement value by an additional $350,000, for a new total not-to-exceed agreement value of $3,970,983, including all subcontractor and reimbursable costs.
- Change Order 2 will increase the agreement value by an additional $783,913.15, for a new total not-to-exceed agreement value of $4,754,896.15, including all subcontractor and reimbursable costs.
Funding for this change order is available in the Street Transportation Department's Capital Improvement Program budget through Capital Construction Funds and Salt River Project's Aesthetics Program funds. The Budget and Research Department will separately review and approve funding availability prior to execution of any amendments. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.

- Change Order 1 to Agreement 145067 on April 3, 2019.
