Description

Request to authorize the City Manager, or his designee, to execute a Facility Relocation Agreement (FRA) with Salt River Project (SRP) for electrical facilities within a City of Phoenix bus bay project at the southwest corner of 32nd Street and Indian School Road, Project - PT00140251.

 

Report

Summary

SRP currently has an electrical facility within a proposed new bus bay location at the southwest corner of 32nd Street and Indian School Road. The electrical facility must be relocated to construct the bus bay.

 

A FRA will be executed to include addressing potential future relocation costs if future relocation of both the existing and new electrical facilities is caused by a City project. The FRA states that the City will pay 50 percent of future relocation costs and SRP will also pay 50 percent of future relocation costs. The FRA will contain additional terms and conditions deemed necessary and appropriate to facilitate future electrical relocations.

 

Further request the City Council to grant an exception pursuant to Phoenix City Code Section 42-20 to authorize indemnification and assumption of liability provisions that otherwise would be prohibited by Phoenix City Code Section 42-18.
