Description

Request to authorize the City Manager, or his designee, to amend Ordinance S-49626, granting an exception to the indemnity and assumption of liability provision of Phoenix City Code Section §42-18, to allow for mutual indemnification pursuant to Phoenix City Code Section §42-20 for public entities.

Report

Summary

On April 19, 2023, the Phoenix City Council approved Ordinance S-49626 to apply for, and if awarded, accept grant funds from the Department of Homeland Security through the Arizona Department of Homeland Security to enhance regional authorities ability to prepare for, prevent, and respond to terrorist attacks and other disasters; and further request authorization for the City Treasurer to accept, and the City Controller to disburse all funds related to this item. The subrecipient agreements from the Arizona Department of Homeland Security include language regarding mutual indemnification. This ordinance would authorize the City Manager to allow indemnification provisions in any subrecipient agreements that would otherwise be prohibited by Phoenix City Code §42-18.

Contract Term

The grant period of performance remains unchanged.
