Description
Request to authorize the City Manager, or his designee, to enter into an agreement with Ludvik Electric Company (Phoenix) to provide Construction Manager at Risk (CMAR) construction phase Guaranteed Maximum Price (GMP) preparation services for the Water System Power Redundancy Phase I project. Further request authorization for the City Controller to disburse all funds related to this item.

Summary
Phase I of this project is to implement standby power systems at Phase I facilities including the Cave Creek Corridor Booster Pump Stations (6A-B1, 7A-B1, and 8A-B1), the Union Hills Water Treatment Plant (WTP) pressure zone 5E, and the Deer Valley WTP pressure zones 1, 2A, and 3D finished water booster pumps. This project will also develop a roadmap for implementing power redundancy in future phases to maintain potable water production at the Union Hills, Deer Valley, 24th Street and Val Vista WTPs. Providing power redundancy at these facilities will improve the City's ability to continue potable water deliveries to customers during potential local or regional utility outages.
Ludvik Electric Company will assume the risk of delivering the project through a GMP. Ludvik Electric Company will be responsible for means and methods related to the project, participating with the City in the goal setting process for Small Business Enterprise (SBE) participation and implementing the SBE process. Ludvik Electric Company will be required to solicit bids from prequalified subcontractors to perform work under the City's subcontractor selection process. Ludvik Electric Company may also compete to self-perform limited amounts of work.
Procurement Information
Ludvik Electric Company was chosen for this project using a qualifications-based selection process according to Section 34-603 of the Arizona Revised Statutes (ARS). Scoring and selection were made in conjunction with the CMAR Design Phase services.
Contract Term
The term for services is expected to be eight months after issuance of the Notice to Proceed. Contract work scope identified and incorporated in the contract prior to the end of the contract may be agreed to by the parties, and work may extend past the termination of the contract. No additional contract work scope changes may be executed after the end of the contract term.
Financial Impact
Ludvik Electric Company's fee will not exceed $18,336 including all subcontractor, subconsultant, and reimbursable costs. Funds are available in the Water Services Department's Capital Improvement Program budget. Contract payments may be made up to the contract limits for all rendered contract services, which may extend past the contract termination. This contract will be amended to include GMP construction services and associated fees.
Concurrence/Previous Council Action
Request for award of the Design Services contract for this project is being submitted simultaneously with a request for award of the Construction Phase Services.

The facilities are located on Cave Creek Road between Dunlap Avenue and Deer Valley Drive.
