Description

Request to authorize the City Manager, or his designee, to execute amendments to Master Agreements 157170 with Fire Protection Service Corporation, dba Pye-Barker Fire & Safety and 157171 with The Hiller Companies Inc. dba American Fire Equipment Sales & Service Corporation to increase each Master Agreement by $6 million to provide additional Fire Alarm Job Order Contracting Services citywide on an as-needed basis. Further request to authorize the execution of amendments to the master agreement as necessary within the Council-approved expenditure authority as provided below, and for the City Controller to disburse all funds related to this item. The additional total fee for services included in this amendment will not exceed $6 million each.

Summary

The State of Arizona (State) and The City of Phoenix (City) entered a cooperative agreement. The Contractors' services will be used on an as-needed basis to provide Job Order Contracting Services citywide that include Fire Alarm Services throughout the Phoenix area.

 

These amendments are necessary because the amount of work under these contracts continue to increase and the available capacity for each contractor is being utilized faster than anticipated. These amendments will provide additional funds to the agreements. The increase for each respective Job Order Agreement project will allow the completion in multiple departments' Capital Improvement Program.

 

Contract Term

The term of the master agreements remain unchanged from the original Notices to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.

 

Financial Impact

The initial agreement for Citywide Fire Alarm Job Order Contracting Services was approved for an amount not to exceed $8 million, including all subcontractor and reimbursable costs. These amendments will increase the agreements by an additional $6 million each, for a new total amount not to exceed $14 million each, including all subcontractor and reimbursable costs.

 

Funding for these amendments is available in the Citywide departments' Capital Improvement Program and Operating budgets. The Budget and Research Department will separately review and approve funding availability prior to the execution of any amendments. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.

 

Concurrence/Previous Council Action

The City Council Approved Citywide Job Order Contracting Services Master Agreements 157170 and 157171 (Ordinance S-49045) on October 12, 2022.
