America's Water Infrastructure Act Risk and Resilience Assessment - Engineering Services - 8434100000 (Ordinance S-46285)
Description
Request to authorize the City Manager, or his designee, to enter into an agreement with Brown and Caldwell, Inc., to provide Engineering Services that include assessment and design for the America's Water Infrastructure Act (AWIA) Risk and Resilience Assessment project. Further request to authorize execution of amendments to the agreement as necessary within the Council-approved expenditure authority as provided below, and for the City Controller to disburse all funds related to this item. The fee for services will not exceed $177,000.
Additionally, request to authorize the City Manager, or his designee, to take all action deemed necessary to execute all utilities-related design and construction agreements, licenses, permits, and requests for utility services related to the development, design and construction of the project and to include disbursement of funds. Utility services include, but are not limited to: electrical, water, sewer, natural gas, telecommunication, cable television, railroads and other modes of transportation. This authorization excludes any transaction involving an interest in real property.

Summary
On Oct. 23, 2018, the AWIA was signed into law. The law requires community drinking water systems serving more than 3,300 people to develop or update risk and resilience assessments and emergency response plans, and establish deadlines by which water systems must certify to the U.S. Environmental Protection Agency (EPA) completion of the assessments and plans.
This project was initiated under the Citywide Engineering/Consulting On-Call Services for Calendar Years 2017-18 for Brown and Caldwell, Inc. to evaluate, revise, and update Phase I of the Water Services Department's emergency response plan. Brown and Caldwell, Inc. was contracted under the current 2019-20 Citywide Engineering On-Call Services contract to complete Phase II updates to build out the emergency response plans. In the meantime, the AWIA requirements were imposed and now need to be incorporated into the emergency response plans. However, Brown and Caldwell, Inc.'s contract capacity is exhausted.
Procurement Information
Brown and Caldwell, Inc. was chosen for this project using a Direct Select process according to Arizona Revised Statutes (A.R.S.) section 34-103. A Direct Select is necessary due to the unique nature of the requirement to certify the plans by March 31, 2020, and to allow Brown and Caldwell, Inc. to continue work they have already done on the emergency response plans.
Contract Term
The term of the agreement is six months from issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.
Financial Impact
The agreement value for Brown and Caldwell, Inc. will not exceed $177,000, including all subconsultant and reimbursable costs.
Funding is available in the Water Services Department's Operating budget. The Budget and Research Department will separately review and approve funding availability prior to execution of any amendments. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.
