Request to Waive Indemnity and Liability Provisions of Phoenix City Code 42-18 to Enter into an Agreement With Gannett Media Corp. (Ordinance S-53226) - Citywide

 

Description

Request to authorize the City Manager, or his designee, to enter into an agreement with Gannett Media Corp. to provide AZCentral Access for the Library Department. Further request the City Council to grant an exception pursuant to Phoenix City Code Section 42-20 to authorize indemnification and assumption of liability provisions that otherwise would be prohibited by Phoenix City Code section 42-18. Further request to authorize the City Controller to disburse all funds related to this item. The total value of the item will not exceed $5,000.

This agreement will provide Phoenix Public Library customers with full and timely access to AZCentral news. The online subscription service includes current AZCentral content and a digital edition of the Arizona Republic, ensuring that Library patrons receive comprehensive coverage of local, state and national news.

Procurement Information

In accordance with Administrative Regulations (AR) 3.10, standard competition was waived as subscriptions are exempt. AR 3.10 section I(6)(B)(3) provides: "Books, periodicals, newspapers, and magazine subscriptions that are impractical to compete are exempt from all solicitation and determination processes."

 

Contract Term

The subscription will begin on or about October 12, 2026, for a one-year term with no options to extend.

 

Financial Impact

The aggregate contract value will not exceed $5,000 for the one-year aggregate term.

 

Funding is available in the Library Department budget.
