Request: To abandon the 10-foot public utility easement located along the east property line of lots 1 and 2, Block 2, of Pierson Place, per Book 16, Page 3, Maricopa County Records as reflected in Attachment A - Map Case #190025.

Summary

The resolution of the abandonment and the commercial plat, Final Plat for "Acacia Heights," Plat # 190005, are to be recorded together with the Maricopa County recorder on the same day, at the same time. The sequence of recording to be followed is that the resolution is recorded first, then the plat is recorded second.

 

The conditional approval for ABND V190025A had also included an abandonment of a PUE along the south side of Lot 3, Block 2, of Pierson Place (as reflected in Attachment B - Map with Abandonment PUE Location). However, Southwest Gas communicated to city staff that it has facilities in this location and as a result, would not agree to the specific abandonment located on Lot 3. Therefore this requested abandonment does not include the abandonment of the PUE located on Lot 3.

Financial Impact

Pursuant to Phoenix City Code Art. 5, Sec. 31-64 (e) as the City acknowledges the public benefit received by the generation of additional revenue from the private tax rolls and by the elimination of third-party general liability claims against the city, maintenance expenses, and undesirable traffic patterns, also replatting of the area with alternate roadways and new development as sufficient and appropriate consideration in this matter.
