Description

Request the City Council to amend Ordinance S-44894, adopted on July 5, 2018, that authorized the City Manager, or designee, to enter into a one-year agreement with two one-year options, with the National Training Institute on Race and Equity (NTIRE) to conduct implicit bias and cultural competence training. The amendment will correct the vendor name and status, and the amount of disbursed funds.

Ordinance S-44894 should be amended to correct (a) the vendor name from NTIRE to Dr. Bryant T. Marks, an individual; and (b) the amount of funds to be disbursed from an annual amount of $150,000, with an aggregate total not exceeding $450,000, to an initial first year amount not exceeding $180,000 with each remaining option year not to exceed $135,000. The aggregate total contract value will remain the same and shall not exceed $450,000.

Summary

On July 5, 2018, the City Council adopted Ordinance S-44894 that authorized the City Manager, or designee, to enter into an agreement with NTIRE for the provision of implicit bias and cultural competence training to the Phoenix Police Department (PPD). The agreement authorized a one-year agreement, with two, one-year options with the annual cost not to exceed $150,000 and the aggregate amount for the agreement, including both option years, not to exceed $450,000.

During development of the agreement, the prospective contracting parties were able to agree upon a training schedule allowing for completion of the training for all PPD employees (sworn and unsworn) in three and one-half months. In completing the training in this time frame, the first year cost has increased by $30,000 from $150,000 to $180,000. However, the total aggregate contract amount, if the option years are exercised, remains at $450,000.

Finally, the agreement is to be between the City and Dr. Bryant T. Marks, an individual, as this change in the vendor name allows the agreement to be between two legally recognized contracting parties. Dr. Marks is the founder and director of the National Training Institute on Race and Equity.

Contract Term

The agreement will begin in December 2018, and the term shall be one-year with two, one-year options to be exercised if in the best interests of the City. The option years are needed to allow for training of PPD personnel that are hired in the future.

 

Financial Impact

The aggregate cost of the agreement, including the option years, if exercised, will not exceed $450,000. Funds are available in the Police Department's budget.

 

Concurrence/Previous Council Action

This item was approved unanimously by the Public Safety and Veterans Subcommittee at its June 13, 2018, meeting. Additionally, the City Council adopted Ordinance S-44894 on July 5, 2018.
