Description
Request to authorize the City Manager, or the City Manager's designee, to execute separate amendments to Agreement 159854 with Rummel Construction, Inc.; Agreement 159855 with BWC Enterprises, Inc. dba Woodruff Construction; and Agreement 159856 with Primavera Grading & Paving LLC to provide additional Solid Waste Facilities Improvements Job Order Contracting Services for the Public Works Department. Further request to authorize execution of amendments to the agreements as necessary within the Council-approved expenditure authority as provided below, and for the City Controller to disburse all funds related to this item. The additional fee for services included in these amendments will not exceed $30 million.

Summary
The Job Order Contracting (JOC) contractors' services will be used on an as-needed basis to provide Solid Waste Facilities Improvements services for excavation and earthmoving; roadwork and concrete repair; plumbing, piping, and roof repair for the transfer stations; supply and installation of landfill gas pipelines in open and closed landfill environments; supply and installation of landfill gas equipment such as wellheads, valves, sump vaults, wyes, tees, and similar connectors; and forming, supplying, and finishing of concrete for pads, foundations, and backfill. Additionally, the JOC contractors will be responsible for fulfilling Small Business Enterprise program requirements.
These amendments are necessary because additional spending authority is needed. These amendments will provide additional funds to the agreements.
Contract Term
The term of the agreements remains unchanged. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term.
Financial Impact
- The Master Agreement value for each of the JOC contractors was approved for an amount not to exceed $5 million, including all subcontractor and reimbursable costs.
- These amendments will increase each Master Agreement by an additional $10 million, for a new total amount not to exceed $15 million, including all subcontractor and reimbursable costs.
Funding for these amendments is available in the Public Works Department’s Capital Improvement Program budget. The Budget and Research Department will separately review and approve funding availability prior to the execution of any amendments and job ordering agreements. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination.

The City Council approved Solid Waste Facilities Improvements Job Order Contracting Services Agreements 159854, 159855, and 159856 (Ordinance S-50503) on January 24, 2024.
