Request to authorize the City Manager, or his designee, to accept J. Banicki Construction, Inc. as the lowest responsive and responsible bidder and to enter into an agreement with J. Banicki Construction, Inc. for Design-Bid-Build Services for the Phoenix Sky Harbor International Airport (PSHIA) Terminal 4 South 1 Concourse Concrete Apron project. Further request to authorize the City Controller to disburse all funds related to this item. The fee for services will not exceed $10,512,890.50.

Summary
The purpose of this project is to construct new concrete aircraft apron around the currently under construction Terminal 4 South 1 Concourse. The project consists of construction of approximately 48,000 square yards of apron pavement.
J. Banicki Construction, Inc.’s services include, but are not limited to: airfield concrete pavement; GSE/Vehicular concrete pavement; asphalt pavement; pavement base course; drainage structures; jet blast deflection systems; minor electrical work; bollards; manhole and storm drain adjustments; pavement joint sealants; and other work as required for a complete project. All work will be constructed in accordance with FAA Standards. Work will be performed in conjunction and cooperation with the ongoing construction of the PSHIA Terminal 4 South 1 Concourse.
The agreement is essential to the health, safety, and welfare of the public and critical operations for the City.
Procurement Information
The selection was made using an Invitation for Bids procurement process set forth in section 34-201 of the Arizona Revised Statutes. Six bids were received on Sept. 22, 2020 and were sent to the Equal Opportunity Department for review to determine subcontractor eligibility and contractor responsiveness in demonstrating compliance with Disadvantaged Business Enterprise program requirements.

The bid award amount is within the total budget for this project.
The reason for the variance between the Engineer’s Estimate and the lowest responsive, responsible bid is based on the Engineer's Estimate approach to costs and experience from comparable past projects that used alternative delivery methods.
Contract Term
The term of the agreement is five years from issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement before the end of the term may be agreed to by the parties, and work may extend past the agreement term. No additional changes may be executed after the end of the term.
Financial Impact
The agreement value for J. Banicki Construction, Inc. will not exceed $10,512,890.50, including all subcontractor and reimbursable costs.
Funding is available in the Aviation Department's Capital Improvement Program budget. Staff anticipates reimbursement from a Federal Aviation Administration (FAA) grant. The Budget and Research Department will separately review and approve funding availability before execution of any amendments. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement term.
